These Terms apply to customers located in countries of European Union. Besides, these terms also apply to non-EU countries including Iceland, Liechtenstein, and Norway within the European Economic Area (EEA) if they apply EU law pursuant to relevant treaties or agreements.

Please read them carefully before using the Cosy Island website, mobile app, or purchasing any Cosy Island products.

Please note that these terms contain provisions that significantly affect your legal rights. Use of the Sites is subject to these legally binding Terms and constitutes your agreement to be bound by and to act in accordance with these Terms. We reserve the right to change the Terms at any time. Any such changes will be posted on the Sites and you agree to be bound by such changes.

PART I – Terms of Use

1. General

1.1 The Cosy Island website (“Website”) is operated by Cosy Island. Our store is hosted on Shopify Inc. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

1.2 By accessing or using the Website, App, or any Cosy Island product or service, you agree to these Terms of Use. We may amend these Terms where reasonably necessary to reflect changes in law, our services, or business operations.

New terms continued to be used after changes means you accept them.

1.3 Cosy Island products and services are designed for exceptional comfort and enhancing your daily walking experience. Cosy Island footwear is designed to enhance walking comfort and is not intended to serve as a medical or orthopedic device. Our products are not designed to diagnose, treat, or prevent any medical condition. Please consult a qualified podiatrist or healthcare professional if you have any pre-existing foot conditions or specific medical concerns.

You agree not to use Cosy Island products and/or services to make any medical decisions. Any health-related decisions should be made under the guidance of a qualified healthcare professional.

1.4 Your personal information is collected, used, and protected in accordance with our Privacy Policy and Cookie Policy, consistent with privacy laws where applicable. These policies describe what information we collect, how we use it, and your rights.

1.5 Except for User Content, all text, graphics, logos, button icons, images, photographs, audio clips, videos, software, scripts, code, designs, downloadable content, and any other material appearing on the website or as part of the Service are the property of Cosy Island or the parties from whom we license such content, and are protected by law. Cosy Island’s copyrights, trademarks, or trade dress may not be used without our written permission. Such content includes our name and logo, as well as other graphics, logos, page headers, button icons, scripts, and service names associated with Cosy Island’s products, services, and programs. Your access to or use of the Service does not grant you any license or ownership rights regarding any trademarks, service marks, or trade names.

1.6 Our Services are not directed toward children under the legal age of majority in your residence.

2. Liability and Disclaimers

The Website, App, and all Cosy Island products are provided on an “as is” and “as available” basis, conforming certain requirements of contract.

Cosy Island makes no warranties—express or implied—regarding uninterrupted service, accuracy, or fitness for a particular purpose.

To the fullest extent permitted by law, Cosy Island is not liable for indirect, incidental, consequential, or punitive damages.

Nothing in these Terms excludes liability for death, personal injury, or fraud caused by Cosy Island's negligence.

3. Arbitration Agreement and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

By agreeing to these Terms, you and Cosy Island agree to resolve most disputes through binding arbitration instead of court.

3.1 Statutory Rights

Nothing in this Section limits or excludes any rights or remedies that cannot be limited or excluded under applicable law, including mandatory consumer protection laws applicable within the European Union.

3.2 Alternative Dispute Resolution

Where required or available under applicable law, consumers may choose to submit disputes to an alternative dispute resolution ("ADR") body competent to handle consumer disputes. Participation in ADR is voluntary unless otherwise required by applicable law.

Nothing in these Terms prevents you from exercising any rights available to you under applicable consumer protection laws.

3.3 Court Proceedings

If a dispute cannot be resolved through our Customer Support process or, where applicable, through an ADR procedure, either party may bring proceedings before the competent courts.

If you are a consumer residing in a Member State of the European Union, you may bring legal proceedings before the courts of your country of habitual residence, and Cosy Island may bring proceedings only before the courts of your country of habitual residence, unless otherwise permitted by applicable law.

3.4 Cost Allocation

Each party shall bear its own costs and expenses and an equal share of the arbitrators' and administrative fees of arbitration, or fees of judicial procedures. Notwithstanding the foregoing, Cosy Island shall be responsible for its own legal fees and expenses and you shall be responsible for yours, unless the arbitrator finds that either the substance of your claim or the relief sought was frivolous or brought for an improper purpose.

PART II. Terms of Sale

1. Formation of Contract

Your purchase becomes binding once Cosy Island sends a Shipment Confirmation email. Cosy Island may refuse or cancel an order due to product unavailability, payment failure, or pricing errors.

2. Price, Tax, and Delivery

2.1 Prices are displayed in U.S. Dollars (USD) and include applicable sales tax, unless otherwise stated. Sales tax will be calculated at checkout based on your shipping address.

2.2 Delivery estimates are provided for reference only. Cosy Island is not liable for delays caused by carriers, customs, or events beyond its reasonable control.

2.3 Risk of loss passes to you upon delivery. Ownership transfers once full payment has been received.

3. Returns and Refunds

Returns are accepted under our Return & Refund Policy.

Products must be returned in original condition and packaging unless defective.

Monogrammed, personalized products, Gift Cards, and final sale products may not be eligible for return.

4. Limited Warranty

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT COSY ISLAND OR ITS AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING FOR THE INDIRECT LOSS OF PROFIT, REVENUE, OR DATA) ARISING OUT OF OR RELATING TO THE SERVICE, HOWEVER CAUSED, AND UNDER WHATEVER CAUSE OF ACTION OR THEORY OF LIABILITY BROUGHT (INCLUDING UNDER ANY CONTRACT, NEGLIGENCE, OR OTHER TORT THEORY OF LIABILITY) EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some states do not allow limitations on implied warranties or incidental damages, so certain limitations may not apply to you.

5. Governing Law and Venue

These Terms are governed by European Union law, excluding its conflicts of law principles.
